"Among black Americans, 75 percent believe police should not profit from forfeiture, a sentiment shared by 65 percent of white Americans and Hispanic Americans. Many high-profile cases, ranging from highway shakedowns in Tenaha, Tex. to voluminous cash and home seizures in Philadelphia, have devastated the lives of countless people of color. Ending civil forfeiture is a rare transpartisan goal that unites diverse groups like the ACLU, Americans for Tax Reform, the Heritage Foundation and the NAACP.

But so far, very few states have laws that comport with what voters want. Requiring a criminal conviction before civil forfeiture can occur is only on the books in a handful of states, with Minnesota, Montana and New Mexico enacting this reform in the past two years. Moreover, in about 40 states, police and prosecutors can keep at least half of the proceeds generated from forfeiture, according to a 2010 report by the Institute for Justice."
