Steven Postrel Cannabis is still illegal at the Federal level, and yet the Federal government has not chosen to pursue many cases in states where it has been decriminalized. This has been going on for 20+ years, and I've not heard of a single Federal official being prosecuted for this benign neglect. There are also thousands of laws on the books, and a finitie amount of resources (money, manpower, etc) to enforce them. The Executive branch must therefore, triage which laws it enforces. As the Executive branch enforces the law, who is going to enforce a judgment against the Executive branch for not enforcing the law? Finally, legality is only one consideration. As you well know, much evil behavior has been authorized by "the law". I don't think any sane, ethical, or intelligent person would argue that one should enforce evil laws.
