Deanna Williams Yes, that's the theory.  We're also not supposed to go to war unless Congress declares war,  crops you grow for your own use on your own land are not "interstate commerce", and the NSA is not supposed to spy on US citizens. Democrats seem concerned about constitutionality only when Republicans are in power.
