It would be great if she follows through. I suspect she got the idea from former Maine senator Eric Brakey, current executive director of the Free State Project.
Brakey proposed a bill (LR 1747, "An Act to Protect Maine Taxpayers from Unconstitutional Federal Expenditures") that would establish a procedure for the state to withhold payment for federal expenditures that are determined by the Maine Supreme Judicial Court to be in violation of the United States Constitution.
1. Either the Maine House or Senate could request the Supreme Judicial Court to determine whether a federal expenditure is not authorized by the U.S. Constitution.
2. If the court determines an expenditure is unconstitutional, the Legislature may require employers to pay federal withholding taxes for their employees to Maine Revenue Services (MRS) instead of the IRS.
3. The MRS would then determine the amount of unconstitutional expenditure borne by Maine residents and set off that amount from the federal withholding taxes.
4. The withheld funds would be transferred to a segregated account and used either to make up for shortages in federal funding due to the state or to provide refunds to Maine taxpayers proportional to their federal tax payments
